Freedom of Information

The Freedom of Information (Scotland) Act 2002 (FOISA) gives you the right to access information held by Scottish public authorities. This means you can ask us for any recorded information we hold, and we will respond within 20 working days.

Caledonian MacBrayne is committed to being open and transparent. We aim to make as much information as possible available through our published resources.

 

Environmental Information

Requests for environmental information are handled under the Environmental Information (Scotland) Regulations 2004 (EIRs). These give similar rights of access as FOISA but to environmental information.

You don’t need to mention FOISA or EIRs when making a request, we will apply the correct legislation for you.

Your Rights

Under FOISA/EIRs, you have the right to:

  • Request any recorded information we hold
  • Receive a response within 20 working days
  • Receive information in a suitable format where possible
  • Request a review if you’re not satisfied with our response

Data Protection and Your Rights

Freedom of Information gives you the right to request recorded information but does not provide access to your personal data. If you wish to access information we hold about you, this is handled under data protection law.

Under UK GDPR you have specific rights over your personal data, including:

  • The right to access data we hold about you
  • The right to request correction if the data is inaccurate
  • The right to ask us to delete your data Our Privacy Notice sets out what personal data we may process.

  • Include your full name and contact address (email or postal)
  • Clearly describe the information you are looking for

Before making a request

You may find what you need in our published information:

David MacBrayne Ltd (DML), CalMac Ferries Ltd (CFL), and David MacBrayne HR (UK) Ltd are designated as Scottish Public Authorities under FOISA. Together these organisations are collectively referred to as Caledonian MacBrayne.

We use a shared Guide to Information because much of the information applies across all three authorities. This helps ensure transparency and consistency.

Costs

We won’t charge you for answering most information requests.

However, if it takes a lot of time or resources to gather the information, we may need to apply a fee.

Under FOISA, there’s a cost limit of £600 for responding to a single request. If the estimated cost of finding and providing the information is likely to be more than £600, we do not have to provide it.

If that happens, we’ll work with you to refine or narrow your request so we can provide what we can within the cost limit.

Our aim is to provide information wherever possible. If we do not hold the requested information, or if there is a lawful reason to withhold it, we will explain this clearly in our response.

Review and Appeal

If you are unhappy with our response, you can ask us to review it within 40 working days.

If you’re still not satisfied after our review, you can appeal to the Scottish Information Commissioner.

Guide to information

The Freedom of Information (Scotland) Act 2002 (the Act) requires Scottish public authorities to produce and maintain a publication scheme. Authorities are under a legal obligation to publish the classes of information that they make routinely available and tell the public how to access the information and what it might cost.
